Membership & Services Agreement: Italian Citizenship by Descent

This Agreement (“Agreement”) is effective as of the date you execute it (the “Effective Date”) and is entered into by and between GlobalPassport™ (referred to as “GP,” “we,” or “our”) and you (referred to as the “Member,” “you,” or “your”). Collectively, GP and the Member are the “Parties.”

SCOPE OF SERVICES.

  • Overview
    GlobalPassport™ (“GP”) provides personalized assistance for individuals and families seeking dual citizenship and residency. Our goal is to offer a smooth application experience by tailoring each step to your specific needs. As part of your membership, you receive the following core services:
    • Personalized Plan Creation: We develop a custom roadmap for your citizenship journey, with clear milestones and actionable steps.
    • Access to Member Portal: Enjoy secure access to our digital platform, where you can upload, organize, and retrieve vital records.
    • Automated Document Preparation: Our smart technology streamlines document preparation, minimizing manual effort.
    • Document Collection: Built-in checklists and expert guidance help you gather and verify required records efficiently.
    • Application Processing: We review and prepare your application package to meet all official requirements before submission.
    • Progress Tracking: Track your application status in real-time through our online dashboard.
    • Weekly Expert Advisory Sessions: Receive ongoing, personalized guidance and answers to your questions from our citizenship specialists.
    • Roman Tribe Community: Connect with fellow Americans pursuing Italian citizenship—share experiences, get advice, and form valuable connections.
    • Comprehensive Learning Resources: Access guides, tutorials, and FAQs to deepen your understanding of the entire process.
    • Detailed Service Description.
      GP’s services are primarily digital and advisory, including personalized assessments, platform access, document management, and professional guidance. The Member understands these are expert-driven offerings, not physical products, and that their value lies in GP’s specialized knowledge, time, and support.

      Service Commencement and Milestone Acknowledgement.

      Services begin immediately upon payment. The Member agrees that these services are deemed delivered once any of the following occurs:
      • The Member gains access to the GlobalPassport™ platform,
      • The initial assessment is completed, or
      • Initial documents are provided to the Member.
    • This confirms the Member’s understanding that GP invests time and resources from the moment payment is made and that digital services are considered rendered under these conditions.

      Member Responsibilities
      • Consulate and Embassy Appointments: You must schedule and attend any required consular or embassy appointments yourself. Due to official regulations, third-party assistance at these appointments is not permitted.
      • Accurate Information: You agree to provide accurate and complete information needed for GlobalPassport™  to prepare and submit your application.
    • By enrolling in this program, you acknowledge that the above services constitute the full scope of GP’s assistance under this Agreement.


    FEES, COSTS, AND EXPENSES.

    • Professional Fee (“PF”).  The PF you pay covers the immediate allocation of resources and the start-up of services. It is non-refundable except under our Money-Back Guarantee (MBG).
    • Expenses: GP covers standard expenses directly related to document preparation, including certified copies, record authentication, apostilles, and translations, as outlined in the Program Guidelines. However, the Member is solely responsible for certain high-cost document-related fees not included in the professional fee—specifically, the Certificate of Non-Existence of Naturalization (CONE) and the Article 78 and Court Order filing fees associated with New York State vital records. These expenses are excluded due to their elevated cost and must be paid separately by the Member.
    • Non-Refundable Fees: All fees and charges paid to GP—including the PF and related expenses—are non-refundable unless the MBG applies. This reflects the investment GP makes in launching and managing your case.

      Genealogical Research Fee: For an additional fee of $200, the Member may elect to have GP conduct primary and secondary genealogical research to uncover the names, dates, and locations of key events in the Member’s Ancestry Citizenship Tree. This service is provided in addition to the core services described above and will be billed according to the payment schedule outlined in your Customized Quote. As with other services, this fee is non-refundable unless covered by the MBG.

      Customized Quote (“CQ”).
      You received your CQ electronically. It details the PF amount and payment schedule.

      Money-Back Guarantee (MBG): We strive to provide a transparent, reliable citizenship process. Our MBG ensures peace of mind under the following conditions:

      Full Refund Conditions:
      You qualify for a 100% refund of your PF if any of these apply:
      • Official Application Denial: Your application is denied by the authorities, and you choose not to appeal.
    • Partial Refund Conditions: You qualify for a 90% refund of your PF if any of these apply:
      • Ancestral Records Not Found: GP cannot locate your ancestor's birth records despite exhaustive efforts.
      • Disqualifying Naturalization Records: GP finds naturalization records that render you ineligible.
    • When Refunds Are Not Eligible: A refund is not available if:
      • Government Changes: The application fails due to new official standards outside GP’s control.
      • False or Fraudulent Information: The denial is due to misleading or incomplete information you provided.
      • Late Submissions: You fail to submit the required documents within the specified timeframe.

    Refund Timing: If eligible, GP will issue your refund after confirming ineligibility or receiving a denial notice, provided you do not appeal. Refund processing time may vary depending on case complexity.

    Important Notes:

    • • The MBG applies only to the final result of your application.
      • Services delivered at interim milestones are considered complete and non-refundable once provided.
      • We do not offer refunds for completed services unless the final outcome is officially denied for the reasons above.
      • Refund amounts may be subject to deductions for costs already incurred by GP, such as expenses related to vital record retrieval, document translation, or other administrative processing.
      • Except where the MBG applies, all fees are non-refundable. GP makes no guarantee regarding future features, upgrades, or public statements about possible new offerings.
      • Receipt of a refund may be contingent upon signing a standard acknowledgment form, which may include confidentiality or non-disparagement provisions.

    GOVERNING LAW, VENUE AND JURISDICTION. This Agreement is governed by and interpreted under California law. GlobalPassport™ is a Delaware-based corporation with its principal address at 2261 Market Street #1055, San Francisco, CA 94114, USA.

    TERMINATION AND WITHDRAWAL PROVISIONS. CONCLUSION OF THE ENGAGEMENT. You may end this Agreement or withdraw your application at any time by giving GP 30 days’ written notice. Upon termination, GP retains all fees and expenses paid up to the date of termination. Because GP invests substantial resources in your case, no refunds apply unless covered by the MBG.

    To ensure clarity, GP will provide a detailed accounting of services rendered upon request. This policy is intended to maintain transparency and fairness for both parties.

    DISPUTE RESOLUTION
    Chargebacks and Complaints
    Before initiating a chargeback or formal complaint, please give GP a chance to address any concerns. Provide a detailed written notice and allow 30 days for GP to respond and seek a resolution.

    ARBITRATION. If a dispute remains unresolved, it will be handled by a single arbitrator through the International Centre for Dispute Resolution in San Francisco, California. The arbitrator’s decision is final and enforceable in a competent court. Each party bears its own legal costs unless the arbitrator directs otherwise.

    DISCLAIMERS. Members are encouraged to consult independent legal, tax, and investment advisors before using GP’s services. Once your application is submitted, all final decisions—approvals, denials, or delays—depend on government authorities. GP is not liable for external regulatory changes or other factors beyond our control.

    LIMITATION OF LIABILITY. Neither party is liable for indirect, special, punitive, or consequential damages arising from this Agreement or the application process. Any liability is limited to amounts paid under this Agreement. Neither party is liable for claims resulting from changes in laws, policies, or regulations outside their control.

    ENTIRE AGREEMENT. This Agreement embodies the full understanding between you and GP regarding the services provided, superseding all prior or concurrent proposals, agreements, or representations, whether oral or written.
